Ashurst advised Norddeutsche Landesbank – Girozentrale (NORD/LB) on the financing of a railway workshop for the Regensburg-Donautal network.
NORD/LB has entered into a loan agreement with Schienenfahrzeugwerkstatt Regensburg GmbH & Co. KG, a subsidiary of BeNEX GmbH, to finance the acquisition and further expansion of the railway workshop in Regensburg, which was built in 2010. The workshop is leased to agilis Eisenbahngesellschaft mbH & Co. KG (agilis) in order to maintain its extended fleet for the operation of regional rail passenger transport on the lines of the Regensburg-Donautal network.
Agilis was awarded the contract to operate the rail passenger services on the Regensburg-Donautal network in 2021. The underlying transport agreement has a term until the end of 2036 with start of operations in December 2022.
The Ashurst team was led by senior associate Alexandra Heitmann and partner Derk Opitz. They were assisted by senior associate Dr Jan Ulrich Heinemann, associate Patrick Rauch, senior transaction lawyer Ariana Fazlic and transaction lawyer Rina Axhimusa (all Project Finance).
Ashurst already advised on the rolling stock financing for the Regensburg-Donautal network in 2021. Ashurst’s German project finance practice regularly advises on asset finance transactions in the context of regional rail passenger transport financings, including locomotive and tramway financings, and now for the first time also in the area of workshop financing.
