Goulburn Mulwaree Council has become very frustrated at Multiquip’s delaying tactics, in seeking to put off undertaking essential repairs on the Oallen Ford & Jerrara Roads. These roads have significantly failed because of the heavy vehicles placed on that road due to the Multiquip quarry.
Council on Tuesday night resolved to unanimously commence immediate legal action against Multiquip to ensure compliance with the conditions of development consent.
“It is the community who is suffering because of the significant deterioration in the road. Multiquip’s lack of action to undertake the repairs they are legally required to do is unacceptable” said General Manager Warwick Bennett.
The court case will be focused Oallen Ford Road and Jerrara Road, which make up the Multiquip haulage route. Council staff have been meeting with Multiquip, who provided initial project documentation but have not provided updated versions.
“Council feels that Multiquip are using delaying tactics to avoid undertaking the essential repairs which are needed to remediate their substandard works when first undertaken” continued Mr Bennett.
“The shoulders of the road continue to deteriorate, and we do not feel that it is acceptable for the community and road users to continue to have to deal with this.”
The legal action is focused on ensuring Multiquip achieve compliance with the conditions of the original development consent.
“Our number one priority is ensuring Multiquip stop delaying, and get on with fixing the road and achieving a road standard which was agreed on in the original consent” continued Mr Bennett.
Risk mitigation measures may become necessary for road safety as the pavement continues to deteriorate, and as traffic is expected to increase along the route over the summer months Council will continue to monitor the pavement conditions.
