The Administrative Appeals Tribunal acknowledges the recent concerns raised in the Senate Estimates of claims of bullying and harassment against Members.

Unacceptable behaviour and conduct is not tolerated at the Tribunal. We take any allegation of bullying or harassment extremely seriously and will continue to address these allegations fairly, independently, confidentially and with rigour.

We are committed to providing a safe, diverse, and inclusive workplace for our 1,000 members and staff around the country, where all people can work and thrive. Members and staff are encouraged to report instances of bullying or harassment, with guidance provided to them through the internal intranet.

Since coming into this office in April 2022 I have made significant inroads into implementing a reform agenda which includes making workplace culture and wellbeing a priority. Recognising the significance and sensitivity of member performance, conduct and wellbeing, amongst other things, I have brought the responsibility for member capability, culture and wellbeing into the office of the President.

To date the focus has been on developing a dedicated system for Member complaints management including developing a process for the referral of serious complaints to independent investigators, ensuring there are clear escalation points, and ensuring a consistency of approach.

We continue to highlight the Tribunal’s current Code of Members Conduct and the APS Code of Conduct to support collegiate behaviour and assist members to fulfill their statutory obligations to the highest standard.

As part of my personal commitment to providing a safe working environment and improving the culture, we are working across the Tribunal to develop and build a culture roadmap. We have engaged with staff by conducting focus groups regarding “shaping our culture” to enable them to share their views on the current state of the Tribunal culture and the desired future state. We utilise exit surveys for our staff and collect information on their experience of working at the AAT so we can identify issues and seek to improve our employee experience.

Specific training has been provided to Members, facilitated by the Australian Government Solicitor regarding Member obligations under the Code of Conduct, and as to our expectations of Tribunal Members. Revised policies on Preventing Workplace Bullying, Harassment and Discrimination and Resolving Workplace Grievances and Complaints have been developed and are in the final stages of consultation.

I have also made clear my support for and endorsement of an independent and merit-based appointment process for Members. I look forward to working with the Attorney-General in relation to this and any other measures which may be taken to strengthen the AAT.

The Tribunal values and acknowledges the service its members and staff bring to their work, and its importance to all Australians.
