The legal action between Rise Projects and Kempsey Shire Council well continue after a conciliation conference was unable to agree a way forward.
On Thursday 24 October, Council participated in a Section 34 Conciliation conference, as outlined under the Land and Environment Court Act 1979, in hopes of resolving the legal action commenced by Rise Projects in July.
Unfortunately, the parties did not reach an agreement and therefore the proceedings were terminated. As such a formal hearing will be required in the Land and Environment Court.
Parties will appear before the court registrar on 4 November 2024 to receive a hearing date for the case in the Land Environment Court.
This hearing is likely to take place in March or April 2025.
The nature and terms of a concilation conference mean that anything said in the meeting remains confidential.
These legal proceedings are running parallel with the Northern Regional Panel’s review of the Development Application.
