Review of the Construction Industry Portable Paid Long Service Leave Act

The McGowan Government has today announced an independent review of the Construction Industry Portable Paid Long Service Leave Act 1985 to ensure it remains relevant and fit-for-purpose.

The Act was introduced by the then Labor Government to allow construction workers to carry long service leave benefits from employer to employer.

The Construction Industry Long Service Leave Payments Board, trading as MyLeave, is a statutory authority established to carry out the administration of the Act on behalf of eligible employees in the construction industry in Western Australia.

The primary purpose of the Act is to ‘make provision for paid long service leave to employees engaged in the construction industry and for incidental and other purposes’.

After more than 36 years of operation providing approximately $550 million in paid benefits to workers in the construction industry, an independent review of the Act is underway.

Since the commencement of the Act, the industrial relations environment in WA has evolved and the review provides an opportunity to assess whether the Act remains fit-for-purpose and appropriate for the contemporary construction industry.

The independent review by KPMG will determine whether the overarching intent of the Act is being met for the contemporary construction industry and its workers. The review of the Act will consider, report and make recommendations to MyLeave on items included in the terms of reference. A copy of the terms of reference is available .

Stakeholder consultation and submissions for the review will be sought shortly, and stakeholders with an interest in the construction industry will be given the opportunity to participate. More details will be made available on the .

As stated by Industrial Relations Minister Bill Johnston:

“The Construction Industry Portable Paid Long Service Leave Act is nearly four decades old and, in that time, has provided significant benefit to workers and employers in the construction industry.

“The time has come to consider opportunities for improvements to this Act to ensure it keeps pace with the evolution of the industrial relations environment and how it affects the construction industry.

“We recognise the important role of workers in the construction industry and want to ensure that this Act continues to provide benefits to loyal workers.

“In parallel, it should also provide an incentive to attract workers to the industry to benefit the broader construction sector and the Western Australian economy.”
